FOX13 has learned that Mary Winkler has gotten her three daughters back. Winkler picked up her children Friday afternoon. The girls had been living with their paternal grandparents since Winkler killed her husband Matthew in 2006. Now it appears the bitter custody battle is coming to a close.

As soon as Winkler's criminal trial ended, the custody battle began. But Friday, in an unexpected turn of events, she regained physical custody of her three children.

But now, a source said they have turned over custody to the girls' mother.

This is being called the first step to full custody, although no official court order has been filed.

It's unclear why the Winkler's suddenly turned over custody of the girls.


Odd they suddenly caved. They may have realized, with the criminal case over, they were not going to prevail.

Yup. Not enough info to know or understand the why. Still considering she murdered the father, I'm surprised that they gave up the fight. I never did believe that the husband abused the wife. Her accounts in the news weren't credible to me.

Wow, put the kids with the mother who killed the father by shooting him in the back, taking the kids and hiding from the police, and then clsiming she did not know what she was doing.

jurisdiction merely means the court has the authority to make rulings. No petition by grandparents, no ruling. Mary had petitioned. The only other option would be if the state child protection agency petitioned, which is apparently not the case.

Thanks, I learned that one in law school. [;)]

I am not familiar with the law in that state, but in most, once a court removes a child and places them with a relative, they will often have an active case in regards to that child for some duration. I have worked with dozens of children that have been removed and placed in foster care or with a relative.

wonder why she killed her husband? I am serious, the court found her not quilty of first degree murder so, you know maybe, their was credibilty to her story, maybe not.

Unfortunately Pastor Winkler isn't here to defend his name and reputation. Mary saw to that. She also has no proof of any abuse. There were allegations of financial irresponsibility and even fraud by Mary that disappeared as soon as she made her claims of abuse. That should have been followed through on.
